The Role of Workplace Law in Addressing Mental Conditions as an Incapacity: Lessons from the Australian Model

Abstract

The state of employees’ mental health is fundamental for workplace functionality and productivity, necessitating a work environment free from negative factors such as depression and anxiety. This article analyses the efficacy of labour laws in safeguarding employees with mental health issues arising from toxic work environments. It advances two main aims: firstly, it examines mental health conditions in relation to workplace incapacity and disability, emphasising the need for appropriate accommodations for affected employees; and secondly, it argues that the current labour laws inadequately address mental health by focusing predominantly on physical health definitions. The article advocates that adequate amendments should be enacted to existing occupational health laws to include mental conditions as ill health, using the Australian model to highlight the need for a more comprehensive legal framework. Finally, the article contends that labour laws are vital in fostering a workplace that enhances productivity by mitigating psychosocial risk factors.
