Constitutionalism as a Precondition for the Effective Implementation of Decentralisation in Africa: Lessons from South African Democracy

Abstract

This article explores the foundational role of constitutionalism in facilitating effective decentralisation within African states, with South Africa serving as a case study. Using doctrinal legal research methodology, the study critically examines the constitutional frameworks that underpin decentralised governance, focusing on the principles of constitutional supremacy, the rule of law, and the separation of powers. It argues that decentralisation, while widely promoted as a mechanism for enhancing democratic governance, improving service delivery, and fostering local participation, cannot succeed without a robust constitutional order that clearly delineates the powers and responsibilities of various levels of government. South Africa’s constitutional architecture, particularly its entrenched provisions on co-operative governance and the autonomy of provincial and local governments, demonstrates how constitutionalism can serve as a safeguard against centralised overreach and institutional instability. However, the robust constitutional design in South Africa is marred by bad governance outcomes, showing that constitutionalism alone cannot guarantee success. Africa has made enormous strides in embedding decentralisation in its text. Yet the lived reality of constitutionalism often lags behind. The article concludes that for decentralisation to be meaningful and sustainable across Africa, it must be anchored in a culture of constitutionalism that promotes legal certainty, institutional integrity, and respect for the rule of law. Additionally, factors such as political culture, elite incentives, fiscal revenue, and administrative capacity significantly influence outcomes.

Author Biography

Paul Mudau, University of South Africa

Prof Paul Mudau is an Associate Professor in the Department of Public, Constitutional and International Law at the University of South Africa (Unisa). Prof Mudau is an Associate Editor of the Southern African Public Law Journal; and an Editorial Board member of the Turf Law Journal. He is the Founder and Project Leader of the Civic and Voter Education Law Project (CVELP) at Unisa. He was born in Musina, Limpopo Province, where he attended at Makushu Primary School and later went to Musina High School. He holds a Bachelor of Laws (LLB) from the University of Limpopo; a Master of Laws (LLM) in Human Rights and Democratisation in Africa jointly from the University of Pretoria and Makerere University, Uganda; a Master of Laws (LLM) in Law, State and Multilevel Government from the University of the Western Cape; and a PhD in Law from the University of the Witwatersrand. Prof Mudau's doctoral research was entitled: 'The Role of Local Government in Achieving Spatial Equity Through the Realisation of the Right to Housing in South Africa.' His specialised areas of research interests include local government law, constitutional law, human rights law, and electoral law.
